Counter-Notification Process
If you believe a DMCA notice was wrongly filed against your content, you may submit a counter-notification that includes:
Your full contact information (name, address, phone number, and email)
Identification of the removed content with specific URLs
A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification
Your consent to the jurisdiction of Federal District Court for the judicial district in which your address is located
Your physical or electronic signature
Warning About False Claims
Knowingly misrepresenting that material or activity is infringing may subject you to liability under Section 512(f) of the DMCA. KAKADU reserves the right to pursue legal action against parties who submit fraudulent DMCA notifications, including claims for damages and attorneys' fees.
Legitimate DMCA Takedown Requests
For valid copyright infringement claims, the following complete information must be provided to our designated agent at [email protected]:
A physical or electronic signature of the copyright owner or authorized agent
Identification of the copyrighted work claimed to be infringed
Identification of the infringing material with specific URL(s) where it appears
Your contact information (address, phone number, and email)
A statement that you have a good faith belief the use is not authorized by the copyright owner
A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner
Our Response Policy
Upon receiving a complete and valid DMCA notice:
We will promptly remove or disable access to the allegedly infringing content (typically within 24-48 hours)
We will notify the affected user of the removal and provide them with a copy of the DMCA notice
We allow users to submit counter-notifications as permitted by 17 U.S.C. § 512(g)(3)
We may restore removed content after 10-14 business days unless we receive notice that court action has been initiated
Repeat Infringer Policy
In accordance with DMCA requirements (17 U.S.C. § 512(i)), we maintain a strict policy of terminating accounts of repeat infringers in appropriate circumstances. Our system tracks all DMCA notices and counter-notices to identify patterns of infringement.
